Council is proposing to enter into a new Lease Agreement with Optus Mobile Pty Ltd ACN 054 365 696 (Optus) to formalise the continued occupancy of an existing low impact telecommunications tower and cabinet within Cliff Whitworth Reserve, Essendon West.

Project Summary:

Optus have occupied this part of Cliff Whitworth Reserve under a lease which expired 30 October 2020. Optus has remained in overholding since that time under the existing lease.

A new Lease Agreement is now proposed to formalise Optus’ continued occupancy of the site for maintaining and operating a telecommunications network and telecommunications service, which does not involve any change to the existing infrastructure.

Proposal:

Council propose to enter the new Lease Agreement on the following key terms:

  • Commencement Date: Date Lease is signed
  • Term: 10 years
  • Further Term: 2 x options of 5 years each
